CONTEXT

A practice of mechanical and electrical consulting engineers was made the subject of a PI case after designing an Education  building.  The owners of the building filed a professional negligence claim and Consolux was appointed by the practice’s insurers to independently investigate the allegations against their client.

THE CHALLENGE

The dispute had been ongoing for a number of years, during which time the site team had dispersed and witnesses from the consulting engineering practice had moved to other firms.

We were asked to provide an expert witness report and engineering advice to the legal team, which we supplied in accordance with the Civil Procedural Rules practice direction 35 – experts and witnesses.

OUR SOLUTION

Consolux examined the project files, visited the site, interviewed the plaintiff and reviewed the plaintiff’s expert witness report. As a result of our review of the evidence, we produced a report containing engineering calculations that helped discredit many argument of the plaintiff. At the court’s request, Consolux wrote joint experts’ report that addressed key issues on both sides and resolved the situation.

Consolux demonstrated that the plaintiff’s allegations were mostly unfounded and defective in a number of areas, thereby saving the consulting engineer’s insurance company a significant amount of money.
